Cheesecake Shipping Terms and Conditions
Please read this all the way to the end before ordering
Our cheesecake
factory has been shipping
cheesecakes via FedEx since 1989. In that time they have seen
almost every imaginable delivery outcome, and then some that
no one could have possibly envisioned.
It is our goal to make your shopping experience as satisfying as possible.
Therefore, we must alert you
to the following potential shipping / delivery issues.
Please take a moment to review the following before you
place your order.

- Weather Delays: If your cheesecake is
delayed, damaged or never delivered due to severe
weather conditions, FedEx will not honor any Guarantees,
and therefore neither can we. Your cheesecake travels by
airplane in most cases. If the weather delays a fight,
or closes an airport, your cheesecake delivery will be
delayed. FedEx has no control over the weather, nor does
our factory. Therefore there will be no refunds for
late delivery due to weather.
- Signature Release: Please make sure that
somebody will be home to receive the cheesecake!
If FedEx attempts to deliver your cheesecake, and the
recipient is not home, they will leave the cheesecake at
the door if safe to do so. At that point our liability
ends. If for some reason the recipient does not get the
cheesecake, we are not liable. It is your responsibility
to alert the recipient that a perishable package will be
arriving.
We have the Signature Release Program to help you get
your cheesecake delivered. Without it, your cheesecake
would never get delivered if your recipient works during
the day. FedEx would go back 3 days in a row, to find
nobody home, and your cheesecake would be spoiled at that
point.
It is up to you, as the buyer, to provide us with an
address where you know some one will be home to receive
the cheesecake. If they work during the day, and you are
not sure if they will be at home, we recommend that you
ship to a business address. It is your responsibility to
alert the recipient that a perishable package will be
arriving.
All orders must have the recipient's telephone number
and U.S. street address. Products are packaged to stay
deliciously fresh and cool for 24-48 hours from time of
shipment. However, it is your responsibility to alert
the recipient that a perishable package will be
arriving.
- Incorrect Shipping Information: Incorrect
shipping information will most likely result in the
product NOT being delivered on the designated day. The
cost of any reshipped products due to incorrect address
information is the sender's responsibility. Address
corrections will be subject to carrier handling or
correction fees (approximately $12.50). Therefore,
please check all shipping information carefully,
especially zip code information.
- Shipping to a Business Address: If you are
sending your gift to a business or hotel please be aware
that our carriers may deliver the package to a shipping
and receiving department. Please let your recipient know
to expect a perishable package. We are not
responsible if the business is closed and the carrier is
unable to deliver the package. For business addresses,
please include as much information as possible including
company name, telephone number, suite or hotel room
number, recipient's name and department, if applicable.
- Delivery Restrictions: Because our carriers
do not deliver on Sunday or Monday, orders will be
delivered Tuesday through Saturday (May-Dec), Tues-Fri
(Jan-April) Also, our carriers do not deliver on New
Years Day, Thanksgiving Day and Christmas Day or the day
following these holidays. Our carrier is also closed on
4th July, Memorial Day and Labor Day, and as a result
cannot delivery the day following these holidays.
- Please be sure that somebody will be home (some time
during the delivery day) at the delivery address you
provide. We have a signature release (which means that
FedEx will attempt delivery, if the recipient is not
home they will leave the cheesecake if it is safe to do
so) on all cheesecakes. But if the recipient is out of
town, or unavailable for several days we can not be
responsible for spoiled cheesecakes due to their being
away from home. We suggest you ship to a business
address if possible, since the chances of getting a
signature are greater.
- Missing Suite # and Apt. # will result in an Address
Correction Fee of $10.00 and in most cases will delay
the delivery by a day. If delivery was to be on a
Friday, it will be delayed until the following Monday.
- Incorrect addresses in most cases will delay the
delivery at least one day and will incur a $10.00
Address Correction fee.
- Please put a valid DAYTIME telephone number for the
recipient. In the event of a delivery or address
problem, this could make the difference in getting the
cheesecake delivered on time. We will not call the
number for any reason, other that to facilitate
delivery.
- If we ship a cheesecake to the address you provide,
and the cheesecake is refused, or undeliverable for any
reason, we will make every effort to complete delivery,
but you will still be liable the entire purchase price.
- When placing your order please give us a valid
e-mail address that you check regularly, as well as a
phone number where we can reach you during the day. If
there is a problem with the order, address or credit
card number, we need to be able to contact you. Failure
to do this could delay shipment of your Cheesecake. We
will not sell or share this info with anyone for any
reason. Period.
- Orders placed after 9:00 Pacific Time on
Thursday, will be shipped on the following Monday unless
Saturday Delivery is specified. There are extra charges
from FEDEX for Saturday delivery.
- Standard Overnight Delivery is not available in some
RURAL zip codes. If Standard Overnight is not available,
we will ship the cheesecake Priority Overnight and there
will be a $5.00 additional fee.
- Saturday Delivery is not available to some RURAL zip
codes. In this case we will notify you as soon possible.
- FedEx does not guarantee any shipments during the
last week before Christmas, so therefore we can’t
guarantee them either. For 2006 this means any shipment
from 12/18 thru 12/23. Please ship your cheesecake
early, they can be refrigerated for 5-7 days and frozen
for up to 2 months. So why tempt fate?
- If you have chosen to have your cheesecake delivered
on a Saturday but have NOT chosen the Saturday
FedEx shipping option we will automatically include the
Saturday FeDex shipping option when we charge your
credit card.
